TERMS AND CONDITIONS

Unless prior credit arrangements have been made with XenonOz, all orders placed with XenonOz will be charged to a valid MasterCard or Visa credit card at time of shipping.

Our high quality XENON HID conversion kits are all covered by a limited warranty against manufacturer defects (globes 90 days), in which a manufacturer-defective part, in the kit and within the warranty period will be replaced at no additional charge with a similar product.

The warranty is void if the cause of damage or failure is due to abuse, neglect, improper installation, use other than the intended use or application, accidents or natural disasters.

All bulbs are tested and burned-in by the manufacturer prior to delivery. Burst/exploded HID bulbs are not covered by warranty.

We will also refund any kits within 30 days that are in perfect working condition, that have NOT yet been installed, and that are sent back with ALL included components, documentation and in original packaging.

All refunds will be subject to a 20% restocking fee and funds will be issued only after our staff examines the product and finds it defect free. Please contact us to get a return authorisation prior to shipping the item back. Any return without our approval will not be accepted.

It is the purchaser's responsibility to incur all warranty and return shipping charges.

XenonOz cannot be held responsible for the misuse of any products sold or distributed by XenonOz. The customer will bear all possible expenses caused by misuse or mishandling of the products received.

XenonOz strives to provide our clients with the most accurate information possible concerning the use and installation of the kits. However, in all cases it is ultimately the customer's role and responsibility to verify all pertinent information.

XenonOz will endeavor to fill all orders within 7 business days from the confirmation of payment. However under certain conditions beyond our control delivery times may be longer.

Except as specifically set out herein, or contained in any warranty statement provided with the goods, any term, condition or warranty in respect of the quality, merchantability, fitness for purpose, condition, description, assembly, manufacture, design or performance of the goods, whether implied by statute, common law, trade usage, custom or otherwise is expressly excluded.

XenonOz is not liable for any indirect or consequential losses or expenses suffered by the customer or any third party, howsoever caused, including but not limited to loss of turnover, profits, business or goodwill or any liability to any other party.

The customer is solely responsible for all risks relating to or arising from the selection, provision, installation and use of the goods. The customer must indemnify and keep XenonOz harmless from all costs, actions, claims, demands, loss or damage (including all legal costs) arising from or in connection with the goods or as a result of the provision, installation or use of the goods.

XenonOz will not be liable for any loss or damage suffered by the customer where XenonOz has failed to meet any delivery date or cancels or suspends the supply of the goods.

Nothing in these Terms and Conditions is to be interpreted as excluding, restricting or modifying or having the effect of excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods which cannot be excluded, restricted or modified.

The risk in the goods supplied by XenonOz to the customer and all insurance responsibility for theft, damage or otherwise in respect of the goods will pass to the customer immediately upon receipt of the goods by the Customer.

Until full payment in cleared funds is received by XenonOz for all goods supplied by it to the customer, as well as all other amounts owing to XenonOz by the customer:

  1. title and property in all goods remain vested in XenonOz and do not pass to the customer;
  2. the customer must hold the goods as fiduciary bailee and agent for XenonOz;
  3. the customer must keep the goods separate from its goods and maintain the labelling and packaging of XenonOz;
  4. the customer is required to hold the proceeds of any sale of the goods on trust for XenonOz in a separate account, however, failure to do so will not affect the customer's obligation to deal with the proceeds as trustee;
  5. XenonOz may, without notice, enter any premises where it suspects the goods may be and remove them, notwithstanding that they may have been attached to other goods not the property of XenonOz, and for this purpose the customer irrevocably licences XenonOz to enter such premises and also indemnifies XenonOz from and against all costs, claims, demands or actions by any party arising from such action.

The customer assumes all risk and liability for loss, damage or injury to persons or to property of the customer or third parties, arising out of the use or possession of any of the goods sold by XenonOz.
